Limited WarrantyLimited One-Year Warranty on Hand ToolQuicKutz offers a limited one-year warranty on its hand tool. If a defect in the tool appears at any time during the first year after purchase, QuicKutz will repair or replace (at its option) the tool at no cost to you beyond the cost of shipping the defective tool to us.Limited Two-Year Warranty on DiesQuicKutz offers a limited two-year warranty on its cutting dies and embossing dies. If a defect in a cutting die or embossing die appears at any time during the first two (2) years after purchase, QuicKutz will replace the die at no cost to you beyond the cost of shipping the defective die to us.Who Makes this WarrantyThis warranty is made by QuicKutz, Inc., 1365 West 1250 South, Suite 100, Orem, Utah 84058.Who is CoveredThis warranty extends only to the original purchaser of the product. This warranty is intended for natural persons only and does not extend to any corporation, limited liability company, or commercial entity.Owner Registration CardIf a registration card is included with the product, this warranty is conditioned upon your return of the properly completed registration card within sixty (60) days after the date of purchase.Purchase ReceiptOrdinarily, you must retain your original purchase receipt in order to obtain warranty service. QuicKutz may require that you submit a copy of your receipt at the time you request warranty service.What is CoveredThis warranty covers manufacturing defects. During the first year after purchase, this warranty covers parts, labor, and the cost of shipping the repaired (or replacement) product from QuicKutz to you. After the first year, this warranty covers parts and the cost of shipping the repaired (or replacement) product from QuicKutz to you, but you may be charged a small fee for QuicKutz’s labor and handling costs.Where and How to Obtain Warranty ServiceYou can obtain warranty service from QuicKutz at the address indicated below or from any authorized QuicKutz service center. It is your responsibility to deliver or ship the defective product to us (or to the authorized service center) at your expense, together with a copy of your receipt showing date of purchase and a description of the claimed defect, prior to the expiration of the warranty period. QuicKutz may accept a written affirmation of purchase in lieu of a purchase receipt in appropriate circumstances. To obtain information regarding the location of authorized QuicKutz service centers, labor and handling charges (for warranty service requested more than one year after date of purchase), or other information regarding this warranty, you may contact us by mail, e-mail, fax, or phone:QuicKutz, Inc. General Information Exceptions and ExclusionsThis warranty does not include damage or defects resulting from misuse, accident, or any other causes following your purchase of the product.Use of any portion of the QuicKutz® Personal Die Cutting System with any other system voids this warranty. Commercial use of any QuicKutz product voids this warranty. TO THE GREATEST EXTENT PERMITTED BY LAW, THIS WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES NOT EXPRESSLY SET FORTH HEREIN, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Limitation of LiabilityTHE SOLE REMEDIES AFFORDED UNDER THIS WARRANTY ARE REPAIR, REPLACEMENT, OR, IF REPAIR OR REPLACEMENT IS NOT COMMERCIALLY PRACTICABLE OR CANNOT BE TIMELY MADE, A REFUND OF THE PURCHASE PRICE. IN NO EVENT SHALL THE LIABILITY OF QUICKUTZ RELATED TO ANY PRODUCT EXCEED THE PURCHASE PRICE OF THE PRODUCT.YOUR USE OF QUICKUTZ PRODUCTS IS AT YOUR SOLE RISK. QUICKUTZ SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR CONSEQUENTIAL, INDIRECT, SPECIAL, OR INCIDENTAL DAMAGES ARISING FROM OR IN CONNECTION WITH THE USE OF ANY QUICKUTZ PRODUCT. (SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.) Other Legal RightsThis warranty gives you specific legal rights and you may also have other rights which vary from state to state.LIFETIME SERVICE COMMITMENTUnder normal use, the QuicKutz hand tool, cutting dies, and embossing dies should last a lifetime. Even after the limited warranty expires, you (the original purchaser) may contact us regarding any manufacturing defects in a QuicKutz hand tool, cutting die, or embossing die, and we will repair or replace the defective product at a cost to you that is substantially less than purchasing a new one, so long as QuicKutz continues to offer the product for sale in the marketplace. If we can’t repair or replace a defective product that you have purchased (e.g., because it has been discontinued), we will do our best to offer an acceptable substitute. |
